RERA FOR REAL ESTATE AGENT:

Agents are often the first — and possibly only — point of contact for many potential home buyers. The Act had provided a glimmer of hope to home buyers to have a list of agents who would be bound by the Act, so that they are not misled into investing their life’s savings on dubious projects.

                  No real estate agent shall facilitate the sale or purchase of or act on behalf of any person to facilitate the sale or purchase of any plot, apartment or building, as the case may be, in a real estate project or part of it, being the part of the real estate project registered under section 3, being sold by the promoter in any planning area, without obtaining registration under this section.

As per RERA (Real Estate Regulation and Development Act, 2016), only registered real estate agents can facilitate the sale/purchase of properties in a real estate projects registered u/s 3 of the Act ,registration shall be valid for 5 years.

 Every real estate agent required to register as per sub-section (2) of section 9 shall make an application in Form-H along with fees of Rs.10000 for individual and for others Rs 50000 to the Authority along with the documents mentioned under rule 10.

Functions –

  • The agent must have all the records of the promoters as well as their projects. These documents should be presented to the buyers as and when required.
  • He should not advertise or misguide the general public with the facts of the project that are false.

He should understand that being an agent is a responsibility to fairly handle the hard earned money of a common man. Thus, he should not try to trick a customer by giving him false information or by any method. A real estate agent must understand that a buyer, very rarely knows the laws when buying a house and it’s his duty to introduce each law to the eyes of a buyer
